PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEB SITE. Your use of the World Partnership Walk Fundraising Website and the World Partnership Walk App (the Website and the App are collectively referred to as the "Site"), an initiative of Aga Khan Foundation Canada ("AKFC"), is expressly conditioned on your acceptance without modification of the following Terms and Conditions of Use.
By visiting or using the Site, including without limitation to browse, provide content to, access, use its web pages, and/or download messages, information, text, data, software or images, or other materials (the "Materials"), or to send messages, information, text, data, software or images, or other materials to the Site ("Content") (collectively "Use of the Site"), you accept on your behalf and on behalf of any entity on whose behalf you may act, to accept the Terms and Conditions of Use for each use of and each visit to the Site. You should not use the Site if you do not agree to abide by these Terms and Conditions of Use.
LICENSE: Through the Site you may build a personal web presence for a particular individual (i.e. yourself, a family member, a friend or otherwise as permitted by AKFC) (referred to herein as a "subsite".) Such sub-site will be called "Personal Fundraising/Event Page". AKFC grants a non-exclusive, non-transferable, freely revocable, limited license to each user to make personal use only of the Site and the associated services in accordance with these Terms and Conditions of Use. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale or other commercial use of the Site and the associated services, making any derivative of the Site or the associated services, the collection and use of user e-mail addresses or other user information, including, without limitation, any data extraction or data mining whatsoever.
You may display, download and print materials on the Site for your personal use only. Otherwise, the Site and its content may not be copied, reproduced, uploaded, posted, or distributed without the explicit written permission of AKFC.
USE OF THE AKFC WORLD PARTNERSHIP WALK APP: Use of the AKFC World Partnership Walk App ("WPW App") is completely optional. Use of the WPW App is subject to these Terms and Conditions of Use, and your engagement with and through the WPW App in accordance with these Terms and Conditions of Use is your sole responsibility. All information that is shared by you through use of the WPW App is in accordance with AKFC's Privacy Policy at https://www.worldpartnershipwalk.com/en/privacy-policy. If you choose to use the WPW App while participating in the World Partnership Walk (the "Event"), the WPW App functionalities of Motion (which is a GPS enabled function) and Community (which is a direct messaging and public conversation functionality) are optional. Should you choose to use the WPW App, and engage with Motion and Community, you consent to your location information and messaging being visible to others.
WAIVER: By using the Site to raise contributions in your own name, or in someone else's name (the "Honouree"), you agree that you have discussed with that Honouree, or that Honouree's family or legal representative your intentions to raise money for AKFC in that Honouree's name or memory. You also confirm that the Honouree (if alive) or that Honouree's family or legal representative (where the Honouree is deceased or incapacitated) consents to you naming such Honouree on the Site. You understand that AKFC will use all monies collected on this Personal Fundraising/Event Page toward AKFC funded projects. Disbursement of funds will not be directed by or to you or by or to the Honouree's family. All funds raised under the Personal Fundraising/Event Page shall solely benefit AKFC.
RESTRICTIONS ON SITE USE: You agree not to use the Site or email tools made available to you through the Site to upload, post, transmit, add hyperlinks leading to, or otherwise make available any content that is defamatory, obscene, harmful, libelous, abusive, or objectionable. AKFC will have the right in its sole discretion to remove any content that is posted or available through a Site page. AKFC may contact you as needed about the Personal Fundraising/Event Page you are creating and may disable this Personal/Event Fundraising Page at AKFC's sole and complete discretion. Without limiting the foregoing, AKFC has the right to remove any content that violates these Terms and Conditions of Use or is otherwise objectionable.
You agree and represent that all use of this Personal/Event Fundraising Page shall be undertaken at your own risk, that AKFC, its directors, officers, members, employees, contractors, volunteers and agents shall not be liable for any claims, damages, injuries, actions, or causes of actions, whatsoever, to the Honouree or Honouree's family or legal representative, to you , or to your property, or to your executors, heirs, or assigns, arising out of or connected with participation in the Personal/Event Fundraising Page and use of the Site. If you fail to adhere to these Terms and Conditions of Use, you understand that your participation in the Event may be terminated and your use of the Site suspended.
IMPORTING DATA: You agree that you are responsible for all permissions, use of another's name, and for copyright clearance on all material that you place on the Site. You agree to restrict information placed on the Site solely to fundraising activity, using minimal information required to accomplish your goal.
INDEMNITY: You shall defend, indemnify, and hold AKFC and its directors, officers, members, employees, volunteers, contractors, agents, successors and assigns harmless from and against, and shall promptly reimburse them for, any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (including reasonable attorneys' fees) to which any of them may become subject arising out of, based upon, as a result of, or in any way connected with, your importing of any content to the Site, any third party claims of infringement or any breach of these Terms and Conditions of Use, and in particular with disclosing personal information of the Honouree on the Personal/ Event Fundraising Page.
CONSENT: You agree that your use of the Site and any uses of any services or materials are subject to your agreement with the Terms and Conditions of Use and AKFC's Privacy Policy. You agree that you will not violate any local, provincial, federal or international laws in using the Site or in accessing or importing any material to the Site.
SITE ACCESS/POLICY CHANGES: AKFC reserves the right to prohibit, restrict or discontinue your access to certain pages within the Site if you violate any of the Terms and Conditions of Use. AKFC may modify these Terms and Conditions of Use at any time without notice. The modified Terms and Conditions of Use will be effective upon posting on the Site. To remain in compliance, AKFC suggests that you review the Terms and Conditions of Use, as well as AKFC’s Privacy Policy at regular intervals.
DISCLAIMER OF WARRANTY: The Site, its materials, services and other information are provided on an "as is" basis for personal fundraising activities for the World Partnership Walk only. AKFC makes no representations or warranties of any kind, express or implied, as to the Site, the Content, the Materials, including without limitation as to the truthfulness, accuracy, reliability, or completeness of the Site and its content and the operation of this Site. To the fullest extent permissible by applicable law, AKFC disclaims all warranties, express or implied including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and/or infringement. When using the Site, information will be transmitted over a medium that is beyond the control of AKFC.
You acknowledge and agree that AKFC does not operate or control the internet and therefore does not guarantee that the use of the Site will be error-free or free of technology downtimes or unavailability. WAIVER AND RELEASE
Note: If the participant is under the age of majority in the home province, this Waiver and Release is to be reviewed, acknowledged and agreed to by the parent or legal guardian of the participant. All references to I or the participant will then include references to both the parent or legal guardian and the minor participant.
By registering on the Site, I agree to participate in the World Partnership Walk, an in-person fundraising event in which participants walk through a designated route of a specified distance in a respective host city (the "Event"). For more specific information about the Event in your region, please visit www.worldpartnershipwalk.com and select your city from the Walk Cities menu. By clicking the "I accept this waiver and release" button below, you are acknowledging and agreeing to below (please review carefully):
I agree and confirm that:
1) my participation in the Event is voluntary;
2) the Event involves a physical activity, and that I am in good physical condition and suffer from no personal health issues that may prevent me from participating in the Event;
3) at all times during the Event, my safety and safety of any minors under my care remains my sole responsibility;
4) I will discontinue from participating in the Event if requested to do so by any representative of AKFC;
5) I am aware of the inherent risks in participating in the Event, particularly as the Event involves a physical activity, and I voluntarily assume such risks;
6) I will practice appropriate 'physical/social distancing practices' during all phases of my participation in the Event;
7) I will adhere to the guidelines of public health authorities in force at the time of the Event in my jurisdiction, during all phases of my participation which I understand may change over time; and
8) I will comply with all applicable laws as well as all policies, guidelines, obligations and requirements of the venue for the Event and any requirements put in place by AKFC.
I acknowledge that there are elements of risk involved in the Event and that neither AKFC nor its affiliates, associates, directors, officers, members, employees, volunteers or agents nor any sponsors of the Event (the "Releasees") have made any representations or warranties regarding the safety of the Event. IN CONSIDERATION of acceptance as a participant in the Event, I, and if the participant is under the age of majority, the parent or legal guardian of the participant personally and as parent or legal guardian on behalf of the participant, on behalf of myself/ourselves, my/our heirs, executors, administrators, successors and assigns HEREBY RELEASE, WAIVE and FOREVER DISCHARGE the Releasees OF AND FROM ALL claims, liabilities, demands, losses, payments, actions, causes of action, damages, costs and expenses, whether in law, contract, tort, statute or equity, including, without limitation, death, injury, loss, harm or damage to my/our person or property HOWEVER CAUSED arising or to arise by reason of my/our participation in the Event AND NOTWITHSTANDING that same may have been contributed to or occasioned by the negligence of any of the aforesaid ("Claims"). I/WE FURTHER UNDERTAKE TO HOLD AND SAVE HARMLESS and AGREE TO INDEMNIFY all the aforesaid from and against any and all Claims, including all costs, expenses and legal fees, incurred by and or all of them arising as a result or in any way connected to my/our participation in the Event. I/We agree not to make any claim or take any proceedings against any other person or corporation entitled to claim contribution and indemnity from the Releasees. BY CLICKING AGREE I/WE ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED to the above AGREEMENT, RELEASE, WAIVER AND INDEMNITY, and
I/WE WARRANT that the participant is physically fit and otherwise able to participate in this Event.
If I choose to use the World Partnership Walk App while participating in the Event, I understand that the App functionalities of Motion (which is a GPS enabled function) and Community (which is a direct messaging and public conversation functionality) are optional. Should I choose to use the App, and engage with Motion and Community, I understand that my location information and messaging are visible to others.
I authorize and grant to AKFC the right to use and/or record my picture and voice and those of my child/children/guardians on photographs, films, tapes in whole and or in part and to incorporate these recordings and materials into any video, photograph, publication or any other material for promotional and other purposes (including for the promotion of AKFC’s programs and work) and to use and license others to use in perpetuity such recordings and images in any manner of media whatsoever, including unrestricted use of my/our name, voice, and biographic information in connection therewith and without compensation therefor. I hereby transfer to AKFC all copyright and other interests in any film footage or photography taken of me or my child or children/guardians or others during the Event and hereby grant royalty-free permission, including rights to reproduce and/or include in all formats, my or my child/children/guardian's image or likeness for any lawful purpose. AKFC will comply with all legal requirements in connection with the collection, use and storage of any personal information.

I/We agree not to make any claim or take any proceedings against any other person or corporation entitled to claim contribution and indemnity from the Releasees. BY CLICKING AGREE I/WE ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED to the above AGREEMENT, RELEASE, WAIVER AND INDEMNITY, and
I/WE WARRANT that the participant is physically fit and otherwise able to participate in this Event.
If I choose to use the World Partnership Walk App while participating in the Event, I understand that the App functionalities of Motion (which is a GPS enabled function) and Community (which is a direct messaging and public conversation functionality) are optional. Should I choose to use the App, and engage with Motion and Community, I understand that my location information and messaging are visible to others.
I authorize and grant to AKFC the right to use and/or record my picture and voice and those of my child/children/guardians on photographs, films, tapes in whole and or in part and to incorporate these recordings and materials into any video, photograph, publication or any other material for promotional and other purposes (including for the promotion of AKFC’s programs and work) and to use and license others to use in perpetuity such recordings and images in any manner of media whatsoever, including unrestricted use of my/our name, voice, and biographic information in connection therewith and without compensation therefor. I hereby transfer to AKFC all copyright and other interests in any film footage or photography taken of me or my child or children/guardians or others during the Event and hereby grant royalty-free permission, including rights to reproduce and/or include in all formats, my or my child/children/guardian's image or likeness for any lawful purpose. AKFC will comply with all legal requirements in connection with the collection, use and storage of any personal information.
